FDAのマーケティング拒否命令に対する異議申し立て訴訟
現在FDAの出しているマーケティング拒否命令(MDO)は販売の見合わせ、市場からの回収などを求めるものです。1年前に事前申請を出したものしか販売できないよと決めて、申請を提出させ、大手タバコ会社の1商品のみ許可を出し、たくさんのメーカーに拒否命令を返したことに対して、訴訟を起こしている会社が出ています。
許可が出た商品は身近なガソリンスタンドで購入可能で、未成年にPuffbarに続いて人気の商品です。
未成年の使用や喫煙を減らすためのFDAの規制のはずが、タバコ味の大手タバコ会社の電子タバコを吸わせて、その後タバコの喫煙に誘導するのではないかと思われるFDAの動きには大きな疑問を感じます。

FDAに対する業界の訴訟に関するニュースは主にTurningPoint Brandsの成功した挑戦にて記載しています。現在、少なくとも27の他の製造業者および流通業者も、連邦巡回裁判所にマーケティング拒否命令（MDO）の見直しを求める請願を提出しています。
MDOの受領者リストに載っている企業は、9月17日以降、拒否を受けませんでした。つまり、リストに載っている企業のうち、まだ審査の申請を提出していない企業は、30日間の控訴期間を超えています。ただし、裁判所に訴訟を起こした企業のいくつかはFDAのリストに含まれていないため、他の非上場企業がまだ30日の期限内にある可能性があります。（FDAも9月23日以来公式リストを更新していません。）
MDOの審査を求める請願書を提出したメーカーのリストを作成し、場合によってはFDAの強制停止を求める申し立てを作成しました。それらはアルファベット順にリストされており、会社名の横には訴訟の日付、請願を審理する巡回裁判所、およびその他の該当する情報があります。記事でケースを取り上げた場合は、最新の報道がリンクされています。（公衆衛生法センターが作成したリストからのみ名前がわかっている会社については、提出日はありません。）
